This online Privacy Policy (the “Policy”) describes how FATC LLC doing business as “Friends“) ”and the City FATC,” “we,” “us,” or “our”) collect, use, disclose, and secure the personalinformation we gather about you through our websites, (the “Site” or “Sites”), when you use ourSites, apps, and when you otherwise interact with us (collectively, the “Services”).

For purposes of this Policy, personal information means data that classifies as personalinformation, personal data, personally identifiable information, or similar terms under applicabledata privacy and security laws and regulations. It does not include data excluded or exemptedfrom those laws and regulations, such as aggregated, anonymized, or deidentified data. Nothingin this Policy will constitute an admission or evidence that any particular data privacy orinformation security law or regulation applies to FATC generally or in any specific context.

In providing our Services, FATC may collect personal information on behalf and as a serviceprovider for third parties. This Policy does not govern any information we collect on behalf ofthird parties, and you should consult their privacy policies to become familiar with their datacollection and usage practices.

By accessing, browsing, downloading, or otherwise using the Services, you confirm that youhave read, understood, and agreed with this Policy. Beyond this Policy, your use of the Servicesis subject to our Terms of Use. If you do not agree to this Policy or our Terms of Use, you maynot use the Services.

This Policy and the Terms of Use apply regardless of how the Services are accessed and willcover any technologies or devices by which we make the Services available to you.

A. Personal Information You Provide to Us

  • Account Information includes first name, last name, email address, password,mailing address, date of birth and other information to verify your identity. We collectthis information when you provide it directly to us such as when you sign up for theServices, creating an account through the Site, or fill out a form. We collect thisinformation for providing the Services, administrative purposes, and marketing andadvertising our products and services.
  • Profile Information includes information you choose to share or post on your profileon the Services, including your gender, age, occupation, location, relationship status,phone number, music preferences, and events you are interested in attending. Wecollect this information for providing the Services, administrative purposes, andmarketing and advertising our products and services.
  • Chat Logs, includes information included in chats you have with us or other memberson the Services. You understand that when you chat with other members on theServices, we or our service providers, may receive a transcript of your chat. Wecollect this information for providing the Services and administrative purposes.
  • Contact Information includes first name, last name, company name, job title, accountnumber, project name, postal address, telephone number, and e-mail address. Thisinformation also includes designer or specifier information including name, phonenumber, and email address. We collect this information when you provide it directlyto us, such as when you sign up for newsletters, request information about ourServices, create an account, or fill out a form. We collect this information forproviding the Services, administrative purposes, and marketing and advertising ourproducts and services.
  • Payment and Commercial Information includes name, address, account number,company name, phone number, third party payment service provider-relatedinformation, debit or credit card information, purchase and participation history, orother payment processing information. We collect this information for providing theServices and for administrative purposes.

  • Responses to Surveys and Questionnaires includes information you provide to uswhen you respond to marketing materials, promotions, contests, or other surveys. Wecollect this information for administrative purposes and marketing and advertising ourproducts and services
  • Social Media Information includes information that you post by sharing on a blog oranother social media platform. We collect this information for administrative purposesand marketing and advertising our products and services. Please note that yourcomments will be visible to the public, so you should never share personal informationthat you would like to keep private.
  • User-Generated Content includes information about you included in content youupload, comment, or otherwise submit on the Services, such as your name and emailaddress and products you may have purchased. Be aware that as a default, anyinformation you post on the Services, including without limitation reviews, comments,and text, may be available to and searchable by all users of the Services. We collectthis information for providing the Services and administrative purposes.

Marketing Partners
. We may receive additional information about you from third parties or

marketing partners and combine it with other information we have about you.

APIs. We may receive information from third-party APIs that enhance the functionality of ourServices When connecting with third-party APIs, we only share the necessary informationrequired to enable the integration.

Apple’s TrueDepth API. Our mobile app includes optional features that utilize Apple’sTrueDepth API, which we are used to enhance user experience through facial recognitionfeatures. Specifically, we use the TrueDepth API:

The facial data captured by the TrueDepth API is used solely for these purposes. Thisinformation is processed on your device, and we do not receive, store, share, or transmitany face data or facial maps captured by the TrueDepth API to our servers or provide thatdata to any third parties.

3. HOW WE USE PERSONAL INFORMATION WE COLLECT

We use your personal information for a variety of business purposes, including to provide ourServices, for administrative purposes, and to market our products and Services, as describedbelow.

A. Providing Our Services

We use your information to fulfill our contract with you and provide you with our Services, suchas:

  • Managing your information and accounts;
  • Providing access to certain areas, functionalities, and features of our Services;
  • Answering requests for customer or technical support;
  • Communicating with you about your account, activities on our Services, and policychanges;
  • Processing your financial information and other payment methods for products orServices purchased or used; and

To allow you to log into the app using Face ID (if enabled); and

In connection with an optional feature that enables you to obtain a "verified" badgeon your profile.

  • Improving, upgrading, or enhancing our Services;
  • Developing new products and services;
  • Ensuring internal quality control and safety;
  • Authenticating and verifying individual identities, including requests to exercise yourrights under this Privacy Policy;
  • Debugging to identify and repair errors with our Services;
  • Auditing relating to interactions, transactions, and other compliance activities;
  • Sharing personal information with third parties as needed to provide the Services;
  • Enforcing our agreements and policies; and
  • Carrying out activities that are required to comply with our legal obligations.

C. Marketing and Advertising our Products and Services

We may use personal information to tailor and provide you with content and advertisements. Wemay provide you with these materials as permitted by applicable law. Some of the ways wemarket to you include email campaigns, custom audiences advertising, and “interest-based” or“personalized advertising,” including through cross-device tracking.

Other Members. You share data with other members when you voluntarily discloseinformation on the Service for others to see (e.g., your public profile). If someonesubmits a report involving you (such as a claim you violated our Terms of Use), we

may let the reporter know what actions we took, if any, as a result of their report. Thesame applies if you submit a report involving another member.

Business Partners and Affiliates. We may collect personal information from anddisclose personal information with our business partners and affiliates, including legaladvisors and financial advisors, co-branded partners, and other third parties. We maycombine that information with other information we collect about you, but we willalways use the information as described in this Policy. We may also disclose personalinformation to our affiliates, subsidiaries, joint ventures or other companies undercommon control.

Business Transactions or Mergers. We reserve the right to disclose your personalinformation to third parties as part of any potential business or asset sale, merger,acquisition, investment, round of funding, or similar type of transaction.

Account Deletion. If you create an account through our mobile application, you mayrequest the deletion of your account. To delete your account, please visit the mobile

Email Communications. If you receive an unwanted email from us, you can use theunsubscribe link found at the bottom of the email to opt out of receiving future emails.Note that you will continue to receive transaction-related emails regarding products orServices you have requested. We may also send you certain non-promotionalcommunications regarding us and our Services, and you will not be able to opt out ofthose communications (e.g., communications regarding our Services or updates to ourTerms or this Privacy Policy).

Mobile Devices. We may send you push notifications through our mobile application.You may opt out from receiving these push notifications by changing the settings on yourmobile device.

Do Not Track (“DNT”). DNT is a privacy preference that users can set in certain webbrowsers. Please note that we do not respond to or honor DNT signals.

Cookies and Personalized Advertising. You may stop or restrict the placement ofcookies and tracking technologies on your device or remove them by adjusting yourpreferences as your browser or device permits. However, if you adjust your preferences,our Services may not work properly. Please note that cookie-based opt-outs are noteffective on mobile applications. However, you may opt out of personalizedadvertisements on some mobile applications by following the instructions provided byAndroid or iOS. We process personal information on our servers in the United States of America, and may do soin other countries. If you use our Services or otherwise provide us with information from outsideof the United States, you expressly consent to the transfer of your data to the United States, theprocessing of your data in the United States, and the storage of your data in the United States.

Personal information about you provide while in another country, including an EEA memberstate, the UK, or Switzerland may be transferred to the United States. Applicable data protectionlaws may permit such transfers when necessary for the performance of a contract between you

and us, if we obtain your explicit consent to such transfer, or if it is in our legitimate interest totransfer the personal information. The laws in the United States may not be as protective as theapplicable data protection laws in the EEA, UK, and Switzerland or the laws of otherjurisdictions where you may be located.
